Filipinos may be eligible for immigration to Australia by acquiring a Spouse visa if they one is married to an Australian citizen, a permanent resident or in a de facto relationship with an Australian or New Zealand citizen.

There are certain requirements to be obtained in applying a Spousal Visa. One should be able to satisfy the following requirements:

1.    The couple have shown commitment to be a husband and a wife, whether or not the couple are legally married.

2.    The couple has exemplary genuine, strong, and continuing relationship.

3.    The couple lives together, or do not live separately and apart on a permanent basis

4.    Unless legally married, the partner has been in a spouse relationship for the last 12 months that includes they have shown proof that they have lived together.

5.    Both should be in legal age.

6.    The partner must pass the health and criteria area.

Applicants should also remember that they need to take an English proficiency examination such as the IELTS or the International English Language Testing System. Candidates need to take the General Training module and get an overall band score of 4. Once granted with a partner temporary visa (subclass 309), the individual is not permitted to enter Australia until a permanent visa is granted. Furthermore, the individual can work in Australia but will not have access to government funding for tertiary study, and enrol in Australia’s medical benefits expenses and hospital care scheme.

In some cases, an individual may be eligible for permanent residence though the relationship has ended before the end of the two-year period. This applies if the spouse has died during the period, if the couple has children who are under 18 years of age or if the individual has experienced domestic violence within that period.

Regarding visa application charges, the Visa Application Charge is payable in two instalments. The “first instalment” is payable at the time the application has been made and the “second instalment” is before the grant of visa. A base application charge of AUD3085 for subclass 309/100 and subclass 300 is charged to applicants outside Australia.

If you have a partner in Australia, it will be best to prepare all the requirements before hand and have enough money for these applications. It may take a long time but the benefits of being granted that visa will open new doors of opportunity not only for you but to your partner as well.
